Terms and Conditions

§ 1. General Provisions

  1. This Terms of Service document specifies the type, scope, and conditions for providing Services electronically via the WP Crawl Manager Website, including the rules for using the System.
  2. The owner and operator of the Website is BPA Polska Dawid Karamon, ul. Marszałkowska 15/168, 35-215 Rzeszów, NIP: 5170276471, REGON: 180666481. Contact: contact@wpcrawlmanager.com.
  3. Using the Website and the Services provided through it requires prior familiarization with the content of these Terms and their acceptance. Failure to accept these Terms prevents placing an order and using the Services.
  4. Due to the nature of the Services, these Terms do not apply to Consumers.

§ 2. Definitions
In these Terms, the following definitions shall apply:

  1. Price List – a compilation of information on the prices of Services provided by WP Crawl Manager, available on the Website in the “Price List” tab or at https://wpcrawlmanager.com, constituting an integral part of these Terms.
  2. Consumer – a natural person engaging in a legal transaction with an entrepreneur not directly related to their business or professional activity, or an entrepreneur running a sole proprietorship entering into agreements that are not of a professional nature, to whom consumer rights are granted by law.
  3. Service Recipient Account/Account – a section of the Website constituting a set of resources and rights assigned to a specific Service Recipient, accessible after logging in using a username and password, through which the user can access the System and use the Services.
  4. Activation Link – a unique, encoded link generated after payment for a Service order, enabling the activation of the Service Recipient Account.
  5. Billing Period – the period for which the Service Recipient’s obligations related to the Services provided on a subscription basis are settled (e.g., from the 1st to the 30th day of the month).
  6. Subscription Fee – the fee paid by the Service Recipient according to the rates specified in the Price List, for using the Services during a given Billing Period.
  7. Entrepreneur – a natural person (not a Consumer), legal person, or organizational unit with legal capacity, conducting business activities, including partners in civil law partnerships.
  8. Terms of Service – this document regulating the rules for providing electronic services, constituting a standard form contract and fulfilling the information obligation resulting from the provisions on providing electronic services.
  9. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data.
  10. Website – the IT and information platform WP Crawl Manager enabling the use of Services and access to digital content, available at www.wpcrawlmanager.com and its subdomains.
  11. System – the IT solution (SaaS – Software as a Service) provided by WP Crawl Manager, enabling the use of the Website’s functionalities, in accordance with the terms of the Agreement.
  12. Provision of Electronic Services – the performance of a Service remotely by transmitting data at the individual request of the Service Recipient using electronic devices.
  13. Agreement – the agreement for the provision of electronic Services concluded remotely between BPA Polska Dawid Karamon (as the Service Provider) and the Service Recipient, the conditions of which are specified in these Terms, the Price List, and the information available on the Website.
  14. Services – the services provided electronically by WP Crawl Manager, including access to the System, functionalities, and digital content.
  15. Service Recipient – an entrepreneur using the Services for purposes related to their business or professional activity.
  16. Service Provider – BPA Polska Dawid Karamon, as the owner of the Website, provides electronic Services in accordance with these Terms.
  17. Act on Providing Services by Electronic Means – the Act of July 18, 2002, and subsequent amendments, including the provisions of March 3, 2020 (Journal of Laws 2020.344).

§ 3. Technical Requirements

  1. Using the Website, and in particular the Services, requires meeting the following minimum technical requirements:
    • An Internet connection;
    • Possession of devices that allow for the use of Internet resources;
    • A current and correctly configured version of web browsers: Chrome on Android devices and desktop devices, Safari on Apple mobile devices, and the specified Chrome on desktop devices;
    • Use of a web browser that enables the display of hypertext documents related on the Internet via the WWW service and supports the JavaScript programming language, and additionally accepts cookies;
    • Possession of an active email account.

§ 4. Use of the Website

  1. WP Crawl Manager enables the Service Recipient to:
    • Familiarize themselves with information about the scope and conditions of the provision of Services;
    • Create, manage, and delete a Service Recipient Account;
    • Place orders for Service Packages and use the offered functionalities;
    • Contact WP Crawl Manager via the contact form.
  2. By accepting these Terms, the Service Recipient undertakes to:
    • Not provide unlawful content, including offensive, untrue, or indecent content;
    • Refrain from actions that disrupt the functioning of the Website or obtaining access to unauthorized information;
    • Use the Website solely for purposes consistent with the Agreement and the intended use of the System.
  3. In the event of a breach of these Terms or applicable regulations, BPA Polska Dawid Karamon reserves the right to restrict or block access to the Website. The Service Recipient will be notified immediately of any measures taken.
  4. WP Crawl Manager provides Services 7 days a week, subject to the possibility of temporarily suspending the provision of Services in order to carry out maintenance, modernization, or repair work. The Service Recipient will be informed of planned outages electronically.

§ 5. Service Recipient Account

  1. Registration and management of the Service Recipient Account are free of charge.
  2. Registration takes place by completing the registration form available on the Website and providing correct data (e.g., first name, last name, company name, email address, phone number, VAT identification number, etc.).
  3. The Account management Agreement is concluded at the moment of Account activation by the Service Recipient, which occurs by clicking the sent Activation Link.
  4. Logging into the Website requires an email address (as the username) and a password set during registration.
  5. The Service Recipient is obliged to keep confidential the data enabling access to the Account. It is recommended to change the password regularly (e.g., every 30 days) for increased security.
  6. The Account is created for an indefinite period, and the Service Recipient may delete it at any time (through the appropriate function in the account settings or by sending a request to the WP Crawl Manager contact address).
  7. BPA Polska Dawid Karamon reserves the right to temporarily block or permanently delete the Account in the event of a breach of these Terms.

§ 6. Use of the Services

  1. Using the Services requires:
    • Registration and creation of an Account on the WP Crawl Manager Website;
    • Acceptance of these Terms and the Privacy Policy;
    • Familiarity with the current Price List;
    • In the case of paid services – payment of the Subscription Fee.
  2. Service Recipients use only the paid services, in accordance with the chosen option specified in the Price List.
  3. The subscription period for paid services is a specified number of days (30 days), and the commencement of the Service provision takes place at the moment the order is activated.
  4. The Agreement for the provision of paid services is concluded at the moment the order is confirmed by the Service Recipient via the “I Order and Pay” button.
  5. Orders that are not confirmed within the specified deadline (3 business days) will be cancelled.
  6. Paid services will be activated within a specified number of hours (24 hours) from the moment the payment is booked.
  7. The Service Recipient may change the Services option or the Subscription Fee at any time before the end of the current billing period. The new billing period will commence after the end of the current one.
  8. The Agreement for the provision of paid services is valid for the period purchased in accordance with the chosen option and the Price List.

§ 7. Payments

  1. The Service Recipient is obliged to pay the Subscription Fee in advance, according to the Price List, within 7 days from the confirmation of the order. Otherwise, BPA Polska Dawid Karamon reserves the right to withdraw from the Agreement and cancel the order.
  2. In the case of non-standard service options, an individual price list applies as determined in a separate agreement.
  3. Payments for the Services are made using the Stripe, Inc. platform (hereinafter: Stripe), which processes transactions with credit cards, debit cards, and other payment methods provided via that platform.
  4. The payment is considered recognized on the date the transaction is confirmed by Stripe, which results in the deposit being credited to the BPA Polska Dawid Karamon account.
  5. The Service Recipient bears the costs of processing payments.
  6. WP Crawl Manager will issue an invoice based on the data provided during Account registration. In the case of a VAT payer, the VAT identification number must be provided and it must be indicated whether a VAT invoice is required.
  7. The Service Recipient consents to receiving invoices electronically.
  8. Any changes regarding subscription fee rates will be published in the current Price List on the Website.
  9. A change in the Price List does not affect the fees already paid under an Agreement concluded before the publication of the new Price List.

§ 8. Termination of Agreements

  1. The Agreement for the provision of Services terminates:
    • In the case of the Account management service – upon the Service Recipient’s request to delete the Account or as a result of BPA Polska Dawid Karamon’s decision to delete the Account for reasons specified in these Terms;
    • In the case of paid services – upon the expiration of the purchased subscription period, if the next period is not paid.
  2. The Service Recipient may terminate the Agreement without stating any reasons by deleting the Account, whereby previous payments are non-refundable.
  3. BPA Polska Dawid Karamon has the right to terminate the Agreement with immediate effect in the event of:
    • The Service Recipient providing incorrect or incomplete data;
    • A justified suspicion of breach of these Terms or applicable laws, which may result in actions described in § 4 paragraphs 3–5.

§ 9. Complaints Procedure

  1. In the event of any objections regarding the functioning of the System or irregularities in the provision of Services, the Service Recipient may submit a complaint by sending a notification to the email address: contact@wpcrawlmanager.com.
  2. The complaint should include:
    • The login/email address associated with the Account;
    • A description of the irregularity, including the date and time of its occurrence;
    • The proposed method for resolving the issue.
  3. WP Crawl Manager may request the Service Recipient to supplement the complaint if the information proves to be incomplete.
  4. The complaint will be reviewed promptly, but no later than within 14 days from its receipt, and the decision will be sent to the email address associated with the Account.
  5. Any other comments regarding the functioning of the Website should be directed to: contact@wpcrawlmanager.com.

§ 10. Technical Support

  1. During the term of the Agreement, the Service Recipient has access to WP Crawl Manager’s technical support as part of the Subscription Fee.
  2. To use technical support, a request must be sent to the email address: contact@wpcrawlmanager.com, describing the problem and the type of irregularity encountered.
  3. Technical support is provided from Monday to Friday (excluding public holidays) from 9:00 AM to 5:00 PM.
  4. Technical support does not cover:
    • Elements modified independently by the Service Recipient;
    • Errors resulting from unauthorized interference with the Service settings;
    • Problems arising from failure to meet the technical requirements specified in § 3.

§ 11. Personal Data Protection and Confidentiality

  1. The administrator of the Service Recipients’ personal data is BPA Polska Dawid Karamon.
  2. Personal data (e.g., first name, last name, company address, email, phone number, VAT identification number, bank account number) are processed solely for the purpose of enabling access to the System and the provision of Services.
  3. Providing data is voluntary; however, its absence may prevent the use of certain functions of the Website.
  4. BPA Polska Dawid Karamon makes every effort to ensure the security and confidentiality of the processed data in accordance with applicable regulations (including GDPR).
  5. Detailed information regarding the protection of personal data and the cookie policy is available in the Privacy Policy on the Website.
  6. The processing of third-party data is carried out based on a data processing agreement, constituting an integral part of these Terms.

§ 12. Intellectual Property Rights

  1. Both the Website and the WP Crawl Manager System contain content protected by intellectual property rights (e.g., graphic elements, logos, software).
  2. Use of the Website does not transfer any intellectual property rights contained therein to the Service Recipient.
  3. WP Crawl Manager grants the Service Recipient a non-exclusive, non-transferable license to use the Website and the System in accordance with their intended purpose and the provisions of these Terms and the Price List.
  4. This license is valid for the duration of the Service provision and expires upon deletion of the Service Recipient Account.

§ 13. Final Provisions

  1. These Terms are available free of charge on the WP Crawl Manager Website.
  2. BPA Polska Dawid Karamon reserves the right to introduce changes to the content of these Terms, subject to the protection of rights acquired by Service Recipients.
  3. Service Recipients will be informed of any changes to these Terms no later than 14 days before they take effect – by displaying a notification on the Website and electronically at the email address associated with the Account.
  4. In the event of non-acceptance of the new conditions, the Agreement shall be terminated as of the day preceding the effective date of the changes.
  5. Matters not regulated by these Terms shall be governed by Polish law.
  6. Any disputes arising from these Terms will be resolved through negotiations, and in the event of no agreement, by the court having jurisdiction over the seat of BPA Polska Dawid Karamon.
  7. These Terms are effective as of March 1, 2025.
